4 - FALLON COUNTY TIMES FRIDAY, JUNE 19, 2015 Recess Relay event May 29. Baker's third through eighth graders gathered on the football field for the annual Recess Relay event. These students participated in many events including the corn hole toss, ladder ball, old clothes race, three-legged race, and many others to sup- port the cause of fighting against cancer. This year, the seventh and eighth graders joined in the fun and stepped up to help run the races and guide younger students to the events. It was a successful relay and everyone had a great time! All funds raised go to the American Cancer Society. Judge's Corner DUI - Refusal to consent to blood or breath tests for alcohol/drugs or both. Section 61-8-402 M.C.A. Blood or breath tests for alcohol, drugs, or both. A person who op- erates or is in actual physical control of a vehicle upon ways of this slate open to the public is considered to have given consent to a test or tests of the person's blood or breath for the purpose of determining any measured amount or detected presence of alcohol or drugs in the person's body. A person who is unconscious or who is otherwise in a condition rendering the person incapable of refusal is considered not to have withdrawn the consent. If an arrested person refuses to submit to one or more tests re- quested and designated by the of- ficer, the refused test or tests may not be given, but the officer shall, on behalf of the department, im- mediately seize the person's dri- ver's license. The peace officer shall immediately forward the li- cense to the department, along with a report certified under penalty of law stating which con- ditions provide the basis for the testing request and confirming that the person refused to submit to one or more tests requested and designated by the peace of- ficer. Upon receipt of the report, the department shall suspend the license for the period provided for per statute. The following suspension pe- riods are applicable upon refusal to submit to one or more tests: (i) upon a first refusal, a suspension of six months with no provision for a restricted probationary li- cense: (ii) upon a second or sub- sequent refusal within five years of a previous refusal, as deter- mined from the records of the de- partment, a suspension of one year with no provision for a re- stricted probationary license. If a person who refuses to sub- mit to one or more tests under this section is the holder of a commercial driver's license, in addition to any action taken against the driver's noncommer- cial driving privileges, the de- partment shall: (i) upon a first refusal, suspend the person's commercial driver's license for a one year period; and (ii) upon a second or subsequent refusal, suspend the person's commercial driver's license for life, subject to department rules adopted to implement federal rules allowing for license reinstatement, if the person is otherwise eligible, upon completion of a minimum suspension period of ten years. If the person has a prior conviction of a major offense listed in 61-8- 802(2) arising from a separate in- cident, the conviction has the same effect as a previous testing This summer, catch up on the news anywhere! Recent negotiations on the Fairview, Montana site re- sulted in an increase in acreage from 144.6 acres to 154 acres as the two landowners agreed to a six month extension of a key term of the option agree- ments. Quantum has signed two year Option Agreements with landowners in Baker, MT; Fairview, MT; Stanley, ND; and Berthold, ND for Energy Center refinery sites and is making progress in firming up relationships with other strategic alliance partners, re- finery design teams, engi- neering firms, major diesel off -take sources and potential funding sources as well as crude supply candidates. Wiseman awarded 2015 Theodore Roosevelt Honor Leadership Program Award Dickinson, ND - Jerilyn Wise- man was one of 14 Dickinson students to be awarded the 2015 Theodore Roosevelt Honor Leadership Program Award. Jerilyn will receive $3,030 a year with admittance to the honors program, renew- able annually for up to four years by remaining in the pro- gram.
