He Leaves Behind a Sorrowing Wife and Two Little Children to Mourn His Absence —A Victim of Cir- ennistances - Sympathetic Judge, Etc., Etc. Saturday the deputy sheriff of Fer- gus county stopped here, on his war to Deer Lodge, having in charge W. H. Burgess, convicted at the last term of court at Lewiston, of having killed Dennis O'Brien, .and sentenced . to thirteen yeais in the Territorial pris- on.—Castle News. The following we take from the Fergus County Argus which gives the particular; of the whole affair: Territory of Montana vs. Wm. H. Burgess; murder. Frank E. Smith and Wm. H. Hunt for plaintiff, Wal- ter A. Burleigh and H. G. arid S. H. McIntire for defendant. Trial by jury; found guilty of murder in the second degree and sentenced to thir- teen years in the territorial prison and to pay costs of action. Of all the twenty-seven criminal cases that have been entered on the docket of the district court hekl for this County, the action of the Terri- tory of Montana vs. William H. Bur- gess is the only one that has com- manded and had the close attention of our citizens in general, and, we may add, the only one iii which the result of the trial was a surprise to the majority of our law abiding cit- izens. As will be remembered by those of our citizens who were residents of Fergus county at the time, William H. Burgess was indicted by the grand jury of the September term of court 1887, charged with the crime of mur- der. He was admitted to bail to ap- pear at this teem of court for trial. The unfortunate killing for which he was indicted occurred on September 10, 1887, on what is known as Crys- tal mountain, about two miles east of Maiden, and the circumstances as shown by the evidence produced Iii court, were about as follows: On September 10th William H. Burgess was in possession of the Florence mine, located on said mountain, and was engaged ie mining. Some time previous to this date a dispute arose as to the ownership of the mine be- tween Burgess and Murray & O'Brien, co -owners with Burgess. Being up- on a military reservation, possession, in the opinion of both parties, was nine points in law, and a party of men ended with six-shooters and Winchester rifles, knowing Burgess was there, went to the mine, for the purpose, as they testified to in court, of taking possession \peaceably if possible, forcibly if they must.\ Harry Johnson, a witness in the case for the defendant, by stratagem evaded the vigilance of the aggress- ive party, and, reaching the mine, inbrmed Burgess of his position, stating that he was surrounded - by armed men bent upon taking. the Florence property. The reputation and character of Burgess are well known to the people of this county, and that he believed his life was in danger upon the receipt of such in- formation, there is no doubt in the minds of the best citizens of the county. Acting upon that belief he shot Dennis O'Brien, the leader of the aggressive party, whom he seen standing within range, and of whom he knew he had the most, if not all, to fear. O'Brien was killed almost instantly. In the afternoon a detachment Of troops from Maginnis came to the mine and Burgess gave himself up, was taken to Maginnis and confined until an order was issued for his transfer to the county - - jail. Then followed the indictment by the Sep- tember term of c - rurt, upon which he was tried at this time by the follow- ing jury: B. H. Bowman, R. A. Clarke, L. H. Sweetland, Ed. Bras- sey, Horace Collins, C. E. Richards, David Taff, C. M. Belden, Eugene Lewright, Solomon Lutz, E. L. Mow- ery, and J. J. Sigafoos. That all of these jurors were entire strangers to defendant, or only had a passing ac- quaintance, and knew nothing of the circumstances of the killing of O'Brien by Burgess is beyond dis- pute. They are all honorable citi- zens - of our county, and were com- pelled by law to find a verdict ac- cording to the evidence, giving the testimony of each witness under oath equal weight, regardless of who he was and what reputation he bore for truth and honor. The court, in sentencing the pris- oner, expresaed himself freely as to his belief in the matter, stating that he was of the opinion that Burgess was the victim of circumstances, and that he should be the first man in Fergus county to be punished by the law for a crime which a few years ago would not have be considered as a crime, was to the court a matter of regret; but he had a duty to perform which he owed to the people of the territory, mad having been duly and legally tried and found guilty by a jury of itis peers, -the wort was com- pelled to pass sentence mpos him. A motion for a new trial and stay of judgment .vas overruled. A. mo- tion on appeal was then served iipon the plaintiff's attorney, which will come before the supreme court at Helena in July. We have known W. H. Burgess and his estimable wife for years, hav- ing lived neighbors with them, and purchased goods aehis store for over a year. We know him to be a man of strict integrity, an affectionate father, and a loving husband. The ties that have been broken were no worthless threads, but fibers of the finest tissue. He was a worthy citi- zen, honest and upright, charitable to a fault, a most excellent companion, and in all a man whom no One could make and substantiate a charge against. That hour was a most un- fortunate one when he first met O'Brien. We never saw the man; he may have been a good man, also; but the chances are that Burgess 'vas in the right. He was not an excit- able man, but cool and collected on all occasions. To show how Mr. Bur- gess stood so far as his word was con- cerned, we will relate a short inci- dent that catne to our notice some- time ago in Butte. We met him on street and he inquired how we were fixed financially, and we told him the old, old story; he says, \let's walk down street,\ we did so, and he went into King & Lowry's and asked Mr. King if lie had a little money to spare., Mr. King replied that he had some, and inquired how inuch he wanted. Burgess answered, 4500. \Oh said King, \is that all I thought you wanted s couple of thou- sand,\ and in a abort time counted him out the money. This has been a sad blow to his wife, and we have no hesitancy in saying that we are nontident that he will yet be released by executive clemency. We say Mr. O'Brien may have been a good man; and he seems to • have had plenty of friends, but the two elements were diametrically op- posed to each other, and the result was that one or the other had to abandon the claim, and neither were Willing to do this. But as to the mur- der, so far as the evidence goes,' it was a dead sure thing that if Bur- gess had not killed O'Brien, he (O'Brien) would have killed Burros, People don't go around in this country with a Winehes‘,er on their arm to shoot ground squirrels, as the squir- rel law has been repealed. We hope -the eyes of the law will take cognizance of the nature of things surrounding this affair, and deal just- ly with the living, and at the same time have all due regard for the deed. 4Ing.
