T , were in town a couple of days this week, a id left Woduesday for Mis soula to look over a bunch of about 1000 horses that are reported to be for sale. They expect to return to this section in a couple o f weeks Sheriff-elect C. W. Taylor has an nounced the appointment of James M. Wilcox as deputy at Sholby. We believe Mr. Wilcox will make a good officei,and sincerely hope his admin istration will be as satisfactory .to the people of the couity as has been Deputy Sheriff Moberly’s. Thos. McGrath arrived here last evening from Great Falls and bus entered upon his duties as head mix ologist at the Club saloon. Deputy Sheriff Burbank come in last evening from Pondera having in cuato ly Chas. GibsoD, an employee at Callahan’s camp. Gibson is slightly demented and an examination will probably be held today. The rumor that Gibsoa has been assisting Ferg in editing the Shelby Independent is untrue, as it will probably not be be necessary to send the unfortunate man to Warm Springs. In Justice Magee’s court at Du puyer last Saturday, Peter Marceau and Sam Choate were bound over to the district court in the sum of $500. The defendants are accused of steal ing a buck, the property of F. D, Cooper. Choate was able to furnish bonds but Merceau could not rustle the required amount and was brought oyar to Choteau tho first of tho week by Deputy Dean and is now a star boarder at the Hotel de Taylor. The commisMiouern appointed by Judge D. F. Smith ut the last termed court, to ascertain the damages caused by tho buildingcf uu irrigation cauat through tho lands of W. H. Franklin by Byron B. Rogers, liavo filed their report with the clorli of the dialrict court. Their iiudings wore us follow s : Wo the undersigned duly appointed commissioners in the mutter of the above entitled cause, met as per ap pointmeut on tho 15th day of Decern ber, 1 DU 2 , ut the house of W. 11 Franklin, uud proceeded to examine tho lands through which right of way is Bought Wo decided to accept the state ments set forth iu tho complaint uad answer ns evidence, and adjourned to moot at Clioteau, Dec. JGtli at 10 o’clock u. m. on which date after duo deliberation wo found ub follows: 1 —Thatdefenduut will bo damaged by said right of way in an amount which we estimate to bo thirty one and 25 100 dollars ($31 25). 2— That defendant will ho damaged through tho segregation of his lauds by such right of way in an amount which wo estimate to be fifty dollars (*-50 00). 3— That plaintiff be required to construct two ( 2 ) subst mtiul bridges and maintain the sumo across any ditch which plaintiff may construct upon said right of way at points to be designated by defondeut. 4— That plaintiff be required to construct such ditch in a mauuor not to interfere with any system of irri gation maintained hy (lie defendant. 5— That said right of way bo twenty fivo (25) feet wido through tho lauds of defendant.
