The county commis sioners of th© several counties shall provide a suitable book and, have recorded therein a. descrip lion showing the date of laying out, the width, length, and ter mini of all county roads now or hereafter established in their county. S ec . 1807. Not Ifni: in this act shall be to prevent any board of\ cc unty commissioners from mak ing and .awarding contracts for the grading or repairingof roads, 'the const ruction or repairing of bridges on county roads at any time when in their judgment such work can be done cheaper and better than by a road supervisor. Nor shall anything in this act. be no con strued as to interfere with the construction and disbursement of any road tax within any incoipor- aied town or city where by law a road tax is collected. S ec . 1S08. The board of count y commis.-ioner shall, at their regu lar meeting in March after having reserved a sunt suiSciMrfo pay’aTl' outstanding indebtedness and such further sums as in their judgment may be needed, for rpecial pur poses, from the general road fund, apportion the remainder among the several road districts of their county, equitably, having refrence to the condition of the highways in the several districts. S ec . 1809. When any petition shall be presented for the action of the f.ounty v commissioners for the laying out, alteration, or vaca tion of anv county road, it.shall be accompanied by satisfactory proof that, notice has been given by ad vertisement posted on the front door of the county clerk’s office, and in three public places in the vicinity of said road or proposed road, thirty days previous to the presentation of said petition to the county commissioners; proof of the posting of said notices, giving time and place, shall be made by affidavit, which shall be filed with .«aid petition. S ec . 1810. It shall be the duty of the' board of county commis sioners of anv countv in. the state *■ \ ■ / to appoint a board consisting of three householders of the county to view and mark out the road prayed for in the petition, and to fix a time for such view, and to cause notices to be posted in three of the most public places along the proposed pew road, at least five days previous to the day fixed for the viewing ( hereof,- gi ving par ties in interest notice that at the lime fixed by the board of county commissioners the viewersNso ap pointed will meet at the point designated in the petition as the starting point of such road, to at tend to their duties as viewers. Proof o f such notice shall be made by affidavit and filed in the office of the county clerk. S ec . 1811. The county clerk shall issue a warrant directed to the fviowers appointed, setting forth their appointment and re qniring them to meet at the time and place named by the board of county commissioners, and to proceed to view and mark out such road, to asssess the damages and benefits accruing to the owners of any of the lands over which the same may pass by rea son of the alteration, widening, changing, or location thereof and the probable cost c f opening such road for travel. S ec . 1S12. The sheriff, constable or any other person of (lie proper county, shall serve the warrants mentioned in the preceding sec (ion by delivering a copy to eacli of the viewers named therein, and the original-shall be returned to the county clerk with the enclose- ment of service thereon. Anv * person appointed road viewer shall be required to take an oath or affirmantion faithfully and im partially to discharge the duties as viewer of the road recited in (lie petition according to law: Provided; That in all cases where an oath or affirmation is required to be taken under the provisions of this article, the, same may be administered by one of the view er3 who lias been previously sworn. S ec . 1813. The viewers ap pointed and served with warrant as herein provided si all meet at the time and place specified in the warraM, and commencing at the place designated in said petition as the starting point of the road sought to be altered, widened, changed, or laid out and establish ed, the said viewers shall proceed to view and mark out the same by setting stakes, blazing trees, turn ing a furrow, or other appropriate monuments to the -terminus named in the petition 1 y the most piacticabh and convenient route that they in their judpmei t can find. They shall assess the bene fits and damages accruing to all persons by reason of the altera tion, widening, changing, or. lay ing out of said road, and award to any person orpeisoi s damages in excess of the 1 enefits ac< ruing to him cr them a sum equal to fuck NO. 8. ' excess, and if the viewers or a ma jority of them be of the opinion that the road should be altered, widened, changed, or laid out and established, they shall cause a sur vey and plat of the same to be made by the county surveyor or other competent person, giving the courses and distances and specifying the land o-ver which the road passes, and all new roads hereafter opened shall in all cases, when it is practicable, be laid out out on subdivisional or section lines, and it shall be the duty of all county commissioners, when it is practicable, without working a hardship upon any settler on petition of a majority of settlers residing upon said road, to change all roads to conform to the provis ions of this section. S ec . 1814. If any viewer duly appointed and served with war rant refuse to act, or is disqualified and does not appear, the other two viewers ma3r fill such vacancy; or if but one of the viewers appears who is qualified and consents to act, he shall appoint two others, who shall be householders, to as sist him, and they shall proceed to view such roaid: ' r S ec . 1815. The viewers shall file a report of the view in the office of the county clerk of the county in which such view was made, ten days before, the next regular meeting of the board of county commissioners held after the same is completed, which shall be signed by a majority of the viewers, and shall contain a full statement of their proceed ings, a description of the land over which such road extends, an estimate of the cost of opening it for travel, and assessment of the damages and benefits accorded to any person or persons by reason of the alteration, widening, chang ing, or laying out of such road, and the sum awarded any person or persons for damages in excess of the benefits assessed to him or them, and whether such road l e practicable and the establishment of it be recommended by them. To this report the viewer» »hall annex the plat, survey and report of the surveyor, provided a sur vey is ordered. For their services « the viewers shall receive a war rant on the county treasurer for a sum to be fixed by the county commissioners not exceeding five dollars per day. S ec . T816.
