Any person, ccm pany. or corporation having in his or their employ any person liable to the tax of three dollars above mentioned to pay shall, at the request of the assessor, give to him a complete list of all the per sons so employed, and if any per son, company, or the superinten dent or managing agent of any corporation shall neglect or refuse furnish said list for five days after demand made to furnish it, (he person, compau}7, or corporation so neglecting or refusing shall be liable for the tax, and the assessor shall proceed to levy the same as in eases where persons neglect or refuse to list their property. S ec . 1839. The assessor shall pay over to the county treasurer all moneys collected as a special tax, and take a receipt therefor, and shall also deliver to the treas urer a list of the persons who have paid the same, or for whom it has been paid, and aLo a list of all the persons liable to pay said tax, but who are deluquenr. The tieas- urer shall t hel ea 1 j e.r. collect., .the tax trom such as are delinquent, if in his power, and if not, he shall return a list of all persons who failed to pay to t lie board of county’ commissioners with his annual re port, of taxes collected. The as sessor shall also return a list ot the persons, company, or corpora tiotis mentioned in' section 1838. which have neglected or refused to return a list of the persons in their employ, and the amount for which each has been assessed, and the treasurer shall collect the amount thereof as in other cases of assess ment and levy. S ec . 1840. The erection and re pairing of bridges and approaches thereto, the building of culvets, repairs, and improvements on the roads, the cost or expense of which shall exceed one hundred dollars, shall be let by the county com missioners to the ’ lowest com petent bidder; and every bidder b Tore entering on any ‘work pur suant to contract, shall give a bond to the county, with at least two good and sufficient sureties, in any sum double the amount of the contract, which bond shall be ap proved by the county commis sioners, conditioned for the faith ful execution of the contract. S ec . 1841. Before any contract as aforesaid, shall be lei, thecoun ty commissioners shall advertise for bids therefor, and shall require i bidders to accompany their bids with plans and specifications of the work and they may accept the most suitable plan, and award the contract accordingly, or .may re ject. any and all bids. S ec . 1842. It shall be the duly of the board of county commis sioners at each session thereof lo apportion the amount of money in the treasury available for road purposes to the several road dis tricts, and notify the road super visor of the amount subject to his order, and in no case shall any su per visor be allowed to draw more money than is apportioned to said district. Si-o. 1S43. The provisions of sections 1840 and 1841 shall not apply to temporary obstructions occurring in roads already laid out and opened. S ec . 1844. rJhe board of county commissioners of the several counties may, in their discretion, let to the lowest responsible bid der, in pursuance of this chapter, a contract or contracts for repair ing and keeping in good'order the public roads in any road district now or which may hereafter • be established. S ec . 1S45. The county commis si oners, at their regular quarterly meeting on the first Monday in March, in each year, shall,in their diserfion, advertise for bids fur keeping in proper repair the pub. lie roads in any road district of the county, such advertisement to be published at least once a week for four successive weeks, in some newspaper published within the county, or, if none is published therein, in a newspaper published nearest (he county seat of the coun ty. A copy of said advertisement shall also posted on the door or bulletin board of the court house of the county, for at least four weeks before any contract is awarded. The advertisement shall state the name or number of the road district, for which bids are in vited, and the time of receiving bids, which in no case shall be later than the next quarterly meeting of the board ot county commissioners, on the first Monday of June following. The advertise ment shall also state the length of time the contract shall run, as provided in section 1843 of this chapter. S ec . 1846. All bids must be in writ ting aud subscribed by ihe pi rson or persons bidding; shall be sealed ami addressed to the board of county commissioners, and in- do:sed “ bid for keeping in repair the public roads in (naming the road district).” S ec . 1847. At their regular mfceiiug on first the Monday in June in each year the board of commissioners shall open and ex amine all bids offered, and may either reject all bids or award a contract to the lowest bidder, in pursuace of next section. S ec . 1848. If the commission ers decide to award a contract, the person or persons to whom it is awarded shall, before it is entered into, execute and deliver to the commissioners an undertaking, with two or more sureties, to be approved by the commissioners, in a sum not less than one thous and dollars, conditional that the contractors will keep the public roads and highways of the district (naming it) in good order and re • pair, and suitable for the passage of animals or loadpd wagons, or both, as the case be, for one year from the first day of July follow ing until the same day in the suc ceeding year. Upon the execu tion and acceptance of the said- undertaking, the contract shall be awarded. S ec . 1849. The road supervisor of any road district in. which con tracts may be awarded, in pursu ance of this act, shall inspect the public roads of bis. district,.and re port the condition thereof to the county commissioners on' or be fore each regu’ar quarterly meet ing of the board. The road su pervisor shall also, upon written complaint, that any public road of his district is not in proper repair, proceed without, delay to examine the same, and if found in bad con dition, he shall immediately notify the contractor or contractors to repair the road; and unless the contractor or contractors shall proceed, with reasonable diligence to repair the road, the supervisor shall report the condition d/ the road, and the fact of the notifica tion, aud failure of the contractor or contractors to repair the .same to one or more of the county com missioners, and the boar.d of com missioners, at thier first meeting after receiving said report, shall, or may, in their discretion, au thorize the road supervisor of the district to repair the road, keeping an accurate account of the expense thereof, and shall re port the same, duly verified, to the commissioners, ou or before their next quarterly meeting. The commissioners shall withhold or deduct the cost of such repairs from any sum due or to become due to the person or persons who have contracted to keep the roads in repair. S ec . 1850.
