In the district court of the Fifth Judicial District of the state of Mon- tana -ill and for the county of Madi- son. - In the matter of the appropriation by Pine View Ditch company, a cor- poration, of water from Indian creek, an adjudicated stream. ! - 1 Pursuant to, the - provisions of Sec- tions 4871, and 4872 of the Revised Codes of the state of Montana, notice is hereby given that Pine View Ditch company, a corporation has applied to the district court of the Fifth Judic- ial district of the state of Montana, in and for the county of Madison, to have decreed to it a water right out of Indian creek in said county of Mad- ison, amounting to 100 cubic feet per second of time (4,000 inches miners measurements) of the waters of said creek. It is claimed by the applicant that said water was appropriated as fol- lows: That Harry D. Erenier and .Terome G. Locke posted the notice of appro- priation on May 27, 1910, upon the north bank of said creek, at the northwest quarter of section 27, town- ship 8 south, range one east, M. P. M. That immediately thereafter they commenced the construetionof ditches to convey the waters claimed by them to and upon the hereinafter described lands; that on September 2, 1913, they conveyed by deed of all the wat- er- so appropriated and canal and meansof conveying the water to the Pine View Ditch company. That the said Pine View . Ditch company completed the construction of said ditches and canals and con- veyed the water claimed by it to and upon the following described lands, to wit: SW 1 / 4 ; S 1 / 2 NW%; NW% NW% of Section 26, township 6 south, range i west, section 22; SW% 26, section 34, SW/4 section 26, township 7 south, range 1 west, S1/2 and NW% section 2, section 12, township 8 south, range 1 west, N 1 / 2 section 18, NE%; S 1 / 2 NW%; NE 1 / 4 NW%; NW% SW 1%; section 30, township 8 south, range 1 east, all in Madison county, Montana, containing 3640 acres. That thereafter it made, due appli- cation to the above named court to have said water decreed to it; and thereupon the clerk of said . court ap- pointed William J. Kremer, a com- petent civil engineer, to proceed to measure and determine the - capacity of claimant's canal or ditch, and def : initely locate the exact point of di- version from said Indian creek; that thereupon said civil engineer proceed- ed to locate the exact point of the diversion from it - sid --- strealt --- of -- s - gid Canal to measure the capacity of the same and to determine the location and area of the land to be irrigated by means of said ditch and thereafter the said civil engineer reported back to said court, filing his written reports and maps as required by law, which Said reports and maps and the -appli- cation - for said water - right - are - now - on file in the office of the clerk of said court, and open to the inspection of all interested parties.
