SALE OF TIMBER FLATHEAD INDIAN RESERVATION The Flathead Indian Reservation hereby offers for sale timber in an area known as“ Hog Back Logging Unit” . Sealed bids will be received until 1:00 p.m. local time July 8, 1 985, and must be in duplicate, marked ontheoutside:“ HOG BACKLOGGING UNIT’. Address all bids to the Superintendent, Flathead Agency, Pablo, MT 59855. Oral auction bids will be received by the Superin­ tendent immediately following the posting of sealed bids and will be restricted to bidders who have previously submitted an acceptable sealed bid in accordance with this notice. The acceptable sealed bid of the highest value will be considered the apparent high bid except where the apparent high bidder is a non-Indian in competition with a bonafide Indian bidder, in which case the Indian bidder has 30 minutes in which to match the highest bid. Where two or more bonafide Indian loggers submit acceptable sealed bids and a non-Indian bidder is the apparent high bidder, an oral auction between the bonafide Indian bidders will begin at the value of the apparent high bid, immediately following the posting of sealed bids. The sale contains approximately 824 acres to be logged with a volume of 4,186,000 board feet sawlogs of all species, con­ sisting of 1,412,000 board feet of ponderosa pine and 1,682,000 board feet of western larch, and 1,092,000 board feet of Douglas fir, and other species. The above-stated volumes are estimates and are not guaranteed. Each bidder must state the price per thousand net board feet, Scribner Decimal C Log Scale, that will be paid for timber cut and scaled prior to any rate adjustment as specified in the contract. The contract base index for stumpage adjustment purposes will be the W.W.P.A. index rate for March, 1 985. The high bid will be subject to review and acceptance by the seller and approval by the Bureau of Indian Affairs. Each bidder must state a price per thousand board feet (MBF) net Scribner Decimal C Log Scale, for each of three species. No bid less than $213.99/MBF for ponderosa pine and $65.27/MBF for western larch, and S39.96/MBF for Douglas fir and other species will be con­ sidered. Contract provisions give the purchaser an option to remove wood logs at a fixed rate established semi-annually by the Superintendent. A deposit of Fourteen Thousand Dollars ($14,000.00) in the form of a certified check, bank draft, cashier’s check, postal money order (payable to the Bureau of Indian Affairs) or cash must accompany each sealed bid. At the conclusion of the oral auction, deposits will be returned to all but the apparent high bidder. Any other bidder requesting further consideration for his bid will also have his bid deposit retained. The deposit of the successful bidder will be applied to the purchase price of timber cut on this sale only and/or retained as liquidated damages if the bidder fails to execute the contract. A performance bond of Twenty-Three Thousand Dollars ($23,000.00) is required within thirty (30) days of bid accep­ tance. Performance bonding requirements may be satisfied by use of an IRREVOCABLE LETTER OF CREDIT SUPPORTED BY APPROPRIATE PERFORMANCE BOND, or CORPORATE SURETY BOND, BY AN ACCEPTABLE SURETY COMPANY; OR CASH BOND DESIGNATING THE APPROVING OFFICER TO ACT UNDER A POWER OF ATTORNEY; or NEGOTIABLE U.S. GOVERNMENT BONDS SUPPORTED BY APPROPRIATE POWER OF ATTORNEY AND PERFORMANCE BOND. The right to waive technical defects and to reject any and all bids is reserved. The contract will specify that all designated timber for harvest shall be presented for scaling on or before December 3 1 ,1987.
