NOTICE OF PRIMARY ELECTION I In accordance with Article VI of the Constitution and Bylaws of the Confederated Salish and Kootenai Tribes of the Flathead Indian Reservation, Montana, approved Oct. 28, 1935, as amended Oct. 3, 1981, notice is hereby given that on Nov. 7, 1987, a primary election will be held forthe purpose of filling the expired terms of Tribal Council seats and the unexpired term of a vacated Tribal Council seat from the Arlee District. Under Article V, Section 1, of the Constitution and Bylaws of the Confederated Salish and Kootenai Tribes, the Tribal Coun cil reservesthe right to make selectionstofilltheunexpiredterm of any Council seat vacated. As a measure to allow the involvement of the eligible voters of the Confederated Salish and Kootenai Tribes, eligible candi dates from the Arlee District are encouraged to file under the terms and conditions as set forth below. Any enrolled member of the Confederated Salish and Koote nai Tribes of the Flathead Reservation who resides in the districts may announce his/her candidacy for the Tribal Council by notifying the Executive Tribal Secretary in writing of his/her candidacy no later that October 16, 1987, at 4:30 p.m., providing the following eligibility criteria are met: 1. The candidate must be at least 21 years of age at the time of filing application for candidacy. 2. The candidate must have physically resided in his/her d ¡strict for no less than one year prior to the date of the election. 3. The candidate must never have been convicted of a felony or impeached from public office. Each application for candidacy must be accompanied with a non-refundable $25.00 filing fee and a signed, sworn affidavit attesting to qualifications. (The candidate’s affidavit forms are available from the Executive Tribal Secretary’s office.) Dupuis, Executive Tribal Secretary Dated: Sept. 20, 1987 S ale of timber - F lathead I ndian R eservation The Flathead Indian Reservation hereby offers for sale timber in an area known as “Lozeau Flats*. Sealed bids will be received until 1:00 p.m. local time October 22, 1987, and must be in duplicate, marked on the outside: “ LOZEAU FLATS LOGGING UNIT*. Address all bids to the Superintendent, Flathead Agency, Pablo, MT 59855. Oral auction bids will be received by the Superintendent immedi ately following the posting of sealed bids and will be restricted to bidders who have submitted an acceptable sealed bid in accordance with this notice. The sale contains approximately 2,661 acres to be logged with a volume of 6,624,000 board feet sawlogs of all species, consisting of 3,955,000 board feet of ponderosa pine, and 2,670,000 board feet of Douglas-fir and other species. The above stated volumes are esti mates and are not guaranteed. Each bidder must state price per thousand net board feet, Scribner Decimal C Log Scale, that will be paid for timber cut and scaled prior to any rate adjustment as specified in the contract. The contract base index for stumpage adjustment purposes will be the W.W.P.A. index rate for September, 1987. The high bid will be subject to review and acceptance by the seller and approval by the Bureau of Indian Affairs. Each bidder must state a price per thousand board feet (MBF) net Scribner Decimal C Log Scale, for each species group as follows: 1) Ponderosa pine; 2) Douglas-fir and other species. No bid less than $190.00/MBF for ponderosa pine and $55.00/MBF for Douglas-fir and other species will be considered. Merchantable blue-stained ponderosa pine, which is not a bid item, will be sold at 50% of the ponderosa pine sawlog rate. Contract provisions give the purchaser an option to remove wood logs at a fixed rate established by the Superintendent. A deposit of Twenty-Seven Thousand Dollars ($27,000.00) in the form of a certified check, bank draft, cashier’s check, postal money order (payable to the Bureau of Indian Affairs) or cash must accom pany each sealed bid. At the conclusion of the oral auction, deposits will be returned to all but the apparent high bidder. Any other bidder requesting further consideration for his bid will also have his bid deposit retained. The deposit of the successful bidder will be applied to the purchase price of timber cut on this sale only and/or retained as liquidated damages if the bidder fails to execute the contract. A performance bond of Forty-Five Thousand Dollars ($45,000.00) is required within thirty (30) days of bid acceptance. Performance bonding requirements may be satisfied by use of an irrevocable letter Qf credit, cash or negotiable United States securities. The right to waive technical defects and to reject any and all bids is reserved. The contract will specify that all designated timber for harvest shall be presented for scaling on or before December 31,1989. Before bids are submitted, full information concerning the timber, conditions of the sale, and the submission of bids should be obtained from the Superintendent, Flathead Agency, Pablo, Montana 59855.
